1. DEFINITIONS

In these general terms and conditions the following definitions apply:

Muts: the entrepreneur, established in The Hague at Sloepstraat 33-1, The Hague.

Consumer: the natural person who does not act in the exercise of a profession or business and who enters into a distance contract with Muts.

Service(s): the goods and/or services to be delivered by Muts, of whatever nature, as a result of the distance contract concluded between Muts and the customer.

Distance agreement: an agreement in which, in the context of a system organized by Muts for the distance sale of products and/or services (the webshop), exclusive use is made of one or more communication techniques up to and including the conclusion of the agreement. at a distance.

Remote communication technology: means that can be used to conclude an agreement, without the consumer and Muts being together in the same room at the same time.

Product information: the information provided by Muts about the products, such as product photos, a detailed description of the product and all other information applicable to the specific product on the basis of which the consumer assesses the product.

2. APPLICABILITY

2.1 These general terms and conditions apply to every distance contract concluded between Muts and the consumer, provided that the consumer has had the opportunity to read the text of the general terms and conditions before entering into the distance contract.

2.2 Deviations from these general terms and conditions are invalid, unless agreed in writing between Muts and the consumer.

2.3 If one or more provisions in these general terms and conditions do not appear to apply, the other provisions of these general terms and conditions are still in force.

3. THE OFFER

3.1 The offer via the Muts shop or otherwise in the form of product information and/or prices is without obligation. Obvious errors or mistakes in the product information, both via the webshop and in e-mail traffic resulting from the use of the webshop, are reserved.

3.2 The prices shown in the webshop are consumer prices in EURO, including 21% VAT and excluding shipping costs, unless stated otherwise.

3.3 All (product) information shown in the webshop, such as images and data regarding weights, dimensions, colors, etc. are only approximate. Small deviations between the product information shown and reality cannot give rise to compensation or dissolution.

4. ASSIGNMENT

4.1 The consumer is fully responsible towards Muts for the accuracy of the information provided during the ordering procedure. By placing an order via the webshop, the consumer enters into an agreement with a payment obligation towards Muts.

4.2 A distance contract is binding as soon as receipt of the order has been confirmed by Muts. Until that moment, the consumer can terminate the agreement.

4.3 If there is any doubt about the accuracy of the information provided to or by the consumer during the ordering procedure, Muts reserves the right to cancel or refuse an order within ten working days of receipt of the order, even if it has already been confirmed by Muts.

4.4 The (personal) data provided by the consumer to Muts will only be used by Muts to process the concluded distance contract and to handle any warranty claim.

5. PAYMENT

5.1 Orders placed via the webshop can only be paid by invoice. After placing the order, Muts will send an email with an invoice to check the desired cards. After payment the order will be confirmed.

6. TERM AND DELIVERY

6.1 Orders placed via the webshop will be shipped within 3 working days after confirmation of the order, provided that the ordered items are available from stock. Items that are not available from stock are made to order. The delivery time for this is a maximum of 7 working days. The consumer is kept informed of the status of the order by email.

6.2 If an ordered stock item unexpectedly turns out to be sold out, or if an item available on order cannot be delivered within the period stated under 6.1, the consumer can cancel the order without costs or choose to receive another, equivalent item offered by Muts. .

6.3 All items ordered via the Muts webshop are shipped via PostNL. PostNL does not guarantee delivery when sending packages and letterbox mail without Track&Trace. If an order sent as letterbox post is not delivered by PostNL within a reasonable period, the consumer must inform Muts of this immediately.

6.4 The place of delivery is the address that the consumer has made known to Muts.

7. RIGHT OF WITHDRAWAL

7.1 The consumer has the right to terminate the purchase agreement entered into via the Muts webshop within 14 working days after receipt of the ordered items and to return the items without giving any reason. The consumer must use the return form sent by Muts for this purpose. Muts will immediately confirm receipt of the return form to the consumer. After the purchase agreement has been terminated, the consumer must return the product to Muts within 14 days. The purchase amount including taxes will be refunded to the consumer's account within 14 days after receipt and inspection of the returned items.

7.2 The (shipping) costs and the risk of returning are borne by the consumer and depend on the shipping method and carrier chosen by the consumer for the return.

7.3 Muts reserves the right to refuse a return if it is insufficiently stamped, improperly packaged or damaged.

7.4 If the items returned by the consumer appear to have already been used or have been damaged or become unsellable as a result of (improper) use or (improper) treatment and/or handling by the consumer, Muts will compensate the depreciation in value of the items thus returned. associated with charging the consumer.

7.5 The right of withdrawal lapses in the event of a change in the form of the agreement as referred to in 5.2.

7.6 For correct handling of damages, the customer must provide Muts with the following evidence:

  • A (number of) photo(s) of the protective material and filling material used
  • An order number
  • A photo of the product, including the protective material and filling material used in the shipping packaging, which clearly shows that the product has been carefully packaged by us.

8. WARRANTY

8.1 The consumer is expected to check the items delivered by Muts for any defects as soon as possible after receipt and to notify Muts in writing within 7 working days of receipt of the items, providing a clear and complete description of the defects.

8.2 For purchases via the Muts webshop, Muts is both the manufacturer and seller of the items offered. For Muts items that were purchased through a route other than the Muts webshop, the seller of those items is primarily responsible for processing a warranty claim.

9. FORCE MAJEURE

9.1 Muts is not obliged to fulfill any obligation towards the consumer if Muts is prevented from doing so by force majeure. Force majeure includes all circumstances that make it impossible for Muts to (timely) fulfill the obligation(s) arising from the agreement entered into with the consumer, including the availability and delivery of materials, disruptions in the energy supply, stagnation in transport and other circumstances over which Muts has no influence and of which Muts was or could not reasonably have been aware at the time of entering into the agreement with the consumer.

10. LIABILITY

10.1 Muts can never be held liable for any damage or event as a direct or indirect result of the use of the items supplied by Muts, even if this damage or event is the result of a design, production or material error that is attributable to to Muts.

11. COMPLAINTS AND DISPUTES

11.1 Agreements concluded between Muts and the consumer are exclusively governed by Dutch law.

11.2 Complaints about the execution of the agreement must be submitted fully and clearly described to De Muts within a reasonable time, after the consumer has discovered the defects. A submitted complaint will be answered by Muts within 14 days of receipt.

11.3 If the complaint cannot be resolved by mutual agreement, a dispute arises that is subject to the dispute settlement procedure.

11.4 All disputes between the consumer and Muts relating to or arising from the agreement concluded between the consumer and Muts, the products supplied by Muts or these general terms and conditions themselves will be settled by the competent court.
